Nicollette Sheridan Drops Abuse Claims From Desperate Housewives Lawsuit
Nicollette Sheridan has agreed to drop the abuse allegations from her $20 million lawsuit against Desperate Housewives creator Marc Cherry and ABC, according to The Hollywood Reporter. In a joint stipulation filed Friday, the 47-year-old actress dropped her claim for intentional infliction of emotional distress and said she won't assert any claim for emotional or physical damages. In exchange for agreeing to drop the abuse charges, Sheridan will not have to submit to a mental or physical examination. Sheridan originally sued ABC, Cherry and Touchstone Television in April for charges including alleged assault and battery after she said Cherry struck her on the show's set and continued to engage in abuse behavior. Sheridan claimed she was fired from the prime-time soap when she complained to ABC about Cherry. At the time, ABC said Sheridan's claims were found to be "without merit. " She amended her lawsuit two months later to say that ABC dismissed the incident as Cherry giving her "a light tap on the side of her head for the sole purpose of providing direction for a scene they were rehearsing." Sheridan's suit also includes charges of wrongful termination and sex and gender discrimination.

Zarzuty wobec Cherry'ego zostały odrzucone. Teraz pozostaje już tylko sprawa na linii Sheridan - stacja ABC. Wszystko jednak wskazuje na to, że i tutaj aktorka sromotnie polegnie.

A Los Angeles judge declared a mistrial in former "Desperate Housewives" star Nicollette Sheridan's wrongful termination suit after jurors were deadlocked in reaching a verdict. The jury was split 8 to 4 in favor of Sheridan's case, one short of the nine needed to make a verdict in a civil suit. On Monday, Judge Elizabeth Allen White polled all of the jurors on whether any of them thought that further deliberations would be helpful in reaching a verdict, but they all said no. The jury foreman said that there had been "no movement" on the deadlock this morning. They had indicated earlier that the vote split had not changed since early in the deliberations. Sheridan's attorney, Mark Baute, said he was "110% sure" they would proceed with a retrial of the case. The jury was composed of nine women and three men. Sheridan sued Cherry and Touchstone Television in 2010, claiming that her character was written out of the show in retaliation for an incident in which Cherry struck her during a script dispute. Cherry claimed that he merely tapped her, not hit her, and it was part of direction for a scene. Sheridan's battery claim was dropped from her suit before the case went to the jury, leaving Touchstone Television as the sole defendant. One of the jurors, Beverly Crosby, told reporters that she decided on a myriad of factors, and although she did not explicitly say so, it was clear that she sided with Sheridan's case. She noted that jurors had to decide that Sheridan's version of events was "more likely than not. "Retaliation can be very subtle," she said, noting that in this case there "was a lack of a smoking gun." "It really came down to credibility for me," she said. "I looked at the fact that she was struck without permission," she said, adding that it made the question of whether she was hit or tapped somewhat moot. She and another juror, Johnny Huynh, denied speculation of heated discussion in the jury room. Instead, they said that jurors carefully considered the evidence.
